In order for you to succeed with a loss of support claim you would need to prove that the injured or deceased party supported you and was under a legal obligation to do so. The amount that can be claimed in a loss of support depends on many factors including the level of support that was being received, the age of the party claiming the support and various other contingencies.

As you have indicated that the injured or deceased party was the driver, whether you would have a claim will also depend on whether they were to blame for the collision or not.

Should the court find that the collision was 100% the injured or deceased party’s fault, you would not be successful with a claim against the Road Accident Fund. However, you need to remember that the manner in which the court determines liability and fault is different from they way most lay people would. The court would generally apportion blame amongst the parties involved.
